Terms & Conditions

These terms govern the engagement of Aroon Legal's services. We have written them to be clear and straightforward. If any section raises a question, you are welcome to contact us before proceeding.

Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

"Agreement"
These Terms and Conditions, together with any engagement letter or service confirmation provided to the Client, forming the complete agreement between the parties.
"Aroon Legal" / "We" / "Us" / "Our"
Aroon Legal, a pension legal services practice registered and operating at 56/8 Nimmanhaemin Road Soi 11, Suthep, Chiang Mai 50200, Thailand.
"Client" / "You" / "Your"
Any individual who contacts, engages, or receives services from Aroon Legal, whether in person, by telephone, or by electronic correspondence.
"Services"
The pension legal services described on our website and in any engagement letter, including Pension Plan Review, Disability Pension Application Support, and Coordinated Cross-Authority Pension Recovery.
"Content"
All written materials, reports, correspondence, and documentation prepared by Aroon Legal in the course of providing Services to the Client.

Acceptance of Terms

By engaging Aroon Legal's services — whether by submitting an enquiry, signing an engagement letter, or proceeding with any paid service — you agree to be bound by these Terms and Conditions.

You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are acting on behalf of another person (for example, an elderly relative), you confirm that you have proper authority to do so.

If you do not agree with any part of these Terms, please do not proceed with an engagement. We are happy to discuss any questions before you commit.

Service Description

Aroon Legal provides pension-related legal support services in Thailand, principally to retirees, former employees, and individuals with pension entitlements. Our current service range comprises:

  • Pension Plan Review for Retirees — a detailed review of an existing pension arrangement, covering calculation basis, supplements, deductions, and a comparison with contribution history.
  • Disability Pension Application Support — assistance with the preparation and submission of disability pension applications, including assembly of medical and employment documentation.
  • Coordinated Cross-Authority Pension Recovery — a long-form engagement for matters involving multiple pension authorities, with consolidated client communication and written updates throughout.

Services are provided in English. We operate from our office in Chiang Mai. Matters conducted with Thai-language authorities are handled by our staff; English summaries are provided to all clients.

Geographic restrictions: our services are principally oriented toward pension matters falling under Thai jurisdiction or involving Thai pension authorities. Cross-border matters involving foreign pension schemes are assessed on a case-by-case basis.

Client Responsibilities

Clients are expected to cooperate reasonably with Aroon Legal throughout the engagement. This includes:

  • Providing accurate and complete information relevant to the matter, including documents, correspondence, and personal identification as requested.
  • Responding to requests for instructions or clarification within a reasonable time, so as not to delay proceedings.
  • Informing us promptly of any changes to their circumstances that may affect the matter.
  • Using our correspondence and reports solely for the purpose for which they were prepared, and not distributing them to third parties without our written consent.
  • Refraining from communicating directly with relevant pension authorities about the substantive matter once we have been instructed to act, unless otherwise agreed in writing.

Prohibited conduct includes: providing false or misleading information; attempting to use our services or reports to deceive authorities or third parties; or engaging our services for any purpose that is unlawful under Thai law.

Intellectual Property

All written materials, analysis, letters, reports, templates, and other content prepared by Aroon Legal remain the intellectual property of Aroon Legal unless otherwise agreed in writing.

Upon full payment, you are granted a limited, non-exclusive, non-transferable licence to use the materials we have prepared specifically for your matter, for the purpose of that matter only. This licence does not extend to reproduction for other purposes, public distribution, or use on behalf of third parties.

The Aroon Legal name, logo, and website content are protected. You may not reproduce, adapt, or represent them without prior written consent.

Fees & Payment

Our current service fees are as follows:

Pension Plan Review for Retirees ฿4,500
Disability Pension Application Support ฿18,500
Coordinated Cross-Authority Pension Recovery ฿35,000

All fees are stated in Thai Baht (฿) and are inclusive of our standard professional time for the scope described. Third-party costs — such as official certification fees, courier charges, or government administrative fees — are not included and will be advised separately as they arise.

Payment terms are set out in the engagement letter. For most services, a deposit is required before work commences. Accepted payment methods include bank transfer; details are provided at the time of engagement.

Cancellations and refunds: where work has commenced, fees are not refundable for time and effort already expended. If an engagement is cancelled before any work begins, the deposit may be refunded in full at our discretion. Disputes regarding fees should be raised promptly and in writing.

Confidentiality

We treat all client information as strictly confidential. Details shared during the engagement — including personal data, financial information, correspondence, and the content of your matter — will not be disclosed to third parties without your written consent, except as required by law or in the necessary course of acting on your instructions (for example, correspondence sent to pension authorities on your behalf).

We retain matter files in accordance with our data retention policy, as set out in our Privacy Policy. Closed files are ordinarily retained for seven years before secure disposal.

Disclaimers

Aroon Legal provides legal support and procedural assistance. Our services are not a substitute for formal legal representation in court or tribunal proceedings. Nothing in our correspondence, reports, or website constitutes legal advice specific to your individual circumstances unless provided in writing as part of a formal engagement.

We do not make representations about the outcome of any pension claim or review. The decisions of pension authorities, courts, or other bodies are outside our control, and we cannot and do not predict them.

Our website is provided for general information only. We make reasonable efforts to keep it current, but we do not warrant the accuracy or completeness of any information it contains.

Limitation of Liability

To the extent permitted under Thai law, our total liability to you in connection with any engagement shall not exceed the total fees paid by you for that specific service.

We shall not be liable for any loss of anticipated pension income, consequential loss, or indirect damages arising from our services or any delay or failure in the performance of our obligations, where such delay or failure is caused by circumstances outside our reasonable control, including delays by pension authorities, governmental bodies, or third-party institutions.

Nothing in these Terms limits our liability for fraud, gross negligence, or any matter that cannot lawfully be excluded or limited under applicable Thai law.

Indemnification

You agree to indemnify and hold harmless Aroon Legal, its staff, and associates from any claims, costs, or liabilities arising from:

  • Your provision of false, incomplete, or misleading information to us or to any authority.
  • Your breach of these Terms or any engagement letter.
  • Your use of our materials in a manner not authorised under these Terms.

Termination

Either party may bring an engagement to a close by providing written notice. You may do so at any time; we may do so where continued engagement would be impractical or inappropriate, or where you have materially breached these Terms.

On termination, fees for work completed to the date of termination remain payable. We will return original documents you have supplied and provide a summary of work done to date.

Provisions relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive the termination of any engagement.

Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising in connection with our services shall be subject to the jurisdiction of the competent courts in Chiang Mai Province.

We ask that, before initiating any formal proceedings, you contact us in writing to describe the concern. We will make reasonable efforts to resolve the matter through direct discussion within 30 days of receiving your written notice. Many concerns can be addressed more quickly and satisfactorily through this route.

Where direct resolution is not possible, the parties may agree to refer the matter to a neutral mediator before proceeding to litigation.

General Provisions

Entire Agreement. These Terms, together with any engagement letter, constitute the entire agreement between the parties regarding the subject matter and supersede any prior discussions or representations.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any provision does not constitute a waiver of our right to do so subsequently.

Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a qualified successor practice.

Notices. Any formal notice under these Terms should be sent in writing by email to [email protected] or by post to our Chiang Mai office address. Notices by email are effective upon receipt of a read or delivery acknowledgement.

Changes to These Terms

We may revise these Terms from time to time. Changes will be published on our website, with the effective date updated at the top of this page. Where changes are material, we will take reasonable steps to notify active clients.

Your continued engagement with Aroon Legal after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
